1. Acceptance of Terms

By downloading, installing, or using the DIALED iOS application ("the App"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the App. These Terms apply to all users of the App, including users who invite others as accountability partners.

2. Description of Service

DIALED is an iOS application that monitors your screen time usage (locally, on your device) and sends automated SMS alerts to accountability partners you designate when you exceed screen time limits you configure. The App uses Apple's Screen Time framework, which requires your explicit permission. DIALED is developed and operated by Levi Black.

3. SMS Messaging Program

By using DIALED's partner alert feature, you authorize the App to send SMS messages to phone numbers belonging to individuals who have explicitly opted in via leviblack12.com/invite.

4. User Responsibilities

• You are solely responsible for obtaining consent from any person whose phone number you add as an accountability partner
• You must only invite contacts who have agreed to receive accountability alerts from you
• You are responsible for the accuracy of phone numbers you provide
• You agree not to use DIALED to send unsolicited messages, harass, or contact anyone without their clear consent
• You agree to use the App in compliance with all applicable laws and regulations

5. Opt-In and Opt-Out

Partners opt in by accepting an invite at leviblack12.com/invite, where all required disclosures are presented before consent is recorded. Partners may opt out at any time by replying STOP to any message. Upon opt-out, all messaging to that number will cease immediately. To re-subscribe, partners may reply START.

6. Intellectual Property

All content, design, and code within the DIALED app and website are the property of Levi Black. You may not copy, modify, distribute, or reverse-engineer any part of the App without express written permission.

7. Disclaimer of Warranties

DIALED is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee: (a) uninterrupted or error-free operation; (b) that SMS alerts will always be delivered; (c) the accuracy of Apple's Screen Time framework data. Your use of the App is at your sole risk.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Levi Black shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, DIALED or its SMS features, even if advised of the possibility of such damages.

9. Indemnification

You agree to indemnify and hold harmless Levi Black from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of another person.

10. Termination

We reserve the right to terminate or suspend access to the App at any time, with or without cause, and with or without notice. You may stop using the App at any time.

11. Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to conflict of law principles.

12. Changes to Terms

We may update these Terms at any time. The "Last Updated" date at the top reflects the most recent changes. Continued use of the App after changes constitutes acceptance of the updated Terms.
